Middle Eastern food cart blocked by benches on 86th Street

A controversial Bay Ridge food cart is fighting for its life — and its location — after someone installed a pair of metal benches in its usual spot on Fifth Avenue near 86th Street on Thursday.

Two mysterious benches materialized on the neighborhood’s busiest retail stretch after months of tension between Middle Eastern Halal Cart and nearby business owners, who claim the gyro seller pollutes the sidewalk, attracts rowdy drunks, and gets off without paying the same steep rents as brick-and-mortar restaurants.

In fact, one 86th Street bar owner was hoping to uproot the food cart by installing flower beds on its prime piece of sidewalk real estate when the seats popped up sometime after 4 am — after Sammy Kassen, the cart’s manager, closed up shop for the night.

“Once we left, like robbers, they came and put these benches in,” said Kassen, who had to dismiss his workers for the day and tow the cart away, since his business is only licensed to sell at that corner.

It’s not clear who’s behind the benches. The Department of Transportation said it did not authorize the installation of the seats and 86th Street Business Improvement District manager Patrick Condren, whose organization is in charge of overseeing improvements to the area, denied any knowledge of or involvement in their mysterious appearance.

Staffers for Councilman Vincent Gentile (D–Bay Ridge) and police officers from the 68th Precinct were similarly clueless about the origin of the benches.

But wherever the mismatched street seats — one black and one green — came from, business owners and residents on the block are thrilled to have them.

Tony Gentile, owner of the 86th Street watering hole Lone Star Bar, has long complained about the food cart, going so far as to apply to have planters installed in Middle Eastern’s parking space.

“The corner is filthy,” said Gentile, who insisted he didn’t install the benches himself. “They pour grease onto the sidewalk, they’ve got their customers sitting around eating, and they just leave their garbage. Nobody cleans it up. I see mice and rats coming out of the grate and eating the rice on the sidewalk. It’s a quality of life issue.”

Robert Kundert, whose apartment is directly across the street from Middle Eastern’s typical parking spot, says the cart attracts unsavory characters whose noise keeps him up into the small hours of the morning.

“All night long it’s the same thing. People double-parked, cursing, fighting. They wouldn’t be here if it wasn’t for them,” Kundert said. “When they’re not there during the Muslim holidays, the corner’s quiet.”

Kassen defended the business, saying that Middle Eastern pays permit fees and sales taxes, and that it routinely cleans up its corner.

The benches will only make his staff suffer, according to Kassen.

“We’re like everybody else here,” he said. “We want to work, we want to make money. Our business is permitted to be here. This can’t be legal.”

Kassen might be right — the Department of Transportation says the unsanctioned street seats will be removed, though it’s unclear how long the benches will remain in place, and how long the pita venders will be without a home.

His sidewalk business isn’t popular with neighbors, but Kassen says his cart shouldn’t be held responsible for the behavior of its customers, considering it might actually foster peace among Bay Ridge night owls

“There’s a lot of bars here, a lot of young people,” he said. “If anything, I’d think that the food would calm them down.”

Hey, if no one is owning up to installing the benches and they're not approved by the city, then Kassen (or anyone for that matter) has a perfect right to haul the benches away, trash them, take them home, put them in front of some merchant's front door. Maybe Gentile's place.

It's good to have benches near bus stops for the elderly. On the other hand food carts r taking business away from stores that have high rent in these areas. Food carts should be for areas that lack food purveyors. Why not have a food cart,near fort Hamilton high school. That would give them a lot of business and keep them off the strip this would help,them be a better neighbor as well. Just a thought.

I would certainly like to put his sales tax returns up for an audit after the owner has brought up the topic. He is an all cash business and i guarantee he his underreporting. He does not have a register on the truck to keep track of sales.

It was so nice to actually be able to walk on the corner without the smell and garbage and people standing there eating food! IT IS GROSS! It is disgusting and not fair to the other business owners in the area.. this neighborhood is turning to garbage and nasty halal food carts just do not belong in the upscale neighborhood that it "used" to be... It are these nasty food carts that are turning bay ridge in to a dirty neighborhood. Go somewhere else... WE DON'T WANT YOU HERE! Not to mention how unsanitary the inside of these carts must be. Ive been to the Middle Eastern Food cart over 15 times in the past couple years and I tell you it's worth the drive from Chicago very time I go. The problem here is not the food cart it's the bar and every other establishment in the area that is serving the alcohol and allowing there customers to leave drunk and disturb the area, so really instead of the bar owner and other business owners in the area put the blame on the food cart they should fix there own issues and put the blame on there selfs for not managing there own business right.

The small amount of garbage that the halal cart creates pales in comparison to the amount of property damage and noise pollution that Lonestar makes. Drunk meatheads spilling out at 4AM EVERY DAY: Screaming, fighting, and threatening the safety of the residents of the block. This is an Italian/Arab thing. Lonestar is happy to gladhand the Police and Firemen in the area, so when something like this happens they are happy to look the other way. There is just as much Mcdonalds, Subway, Burger King, Pizza Wagon and Churches Chicken garbage as anything else. Why not evict them? The cart offers food that is better for you (if even barely) at half the price. They paid for the RIGHT to be on that corner and many people appreciate their food.

I am proud to say that a majority of my customers are individuals that served and are still serving in this nations great millatery and also provide great clean and healthy food at a competitive price to all our repeat customers that have been enjoying our food and love our service as well for over 3 years.

I am proud to say that a great number of our customers are millitary personal that are still serving in Our Great Nations millitary and also proud to say that we have been serving our bay ridge area great tasty healthy clean food and our customers in witch a majority are repeat customers for the past 3 years are the biggest example of a well established and clean food cart who enjoy our food at all times. Maybe you should come and try our food free of charge and tell us what you think after you try our food if you haven't tried it yet. I am proud to say that we provide Great food at competitive prices and also proud to say that we provide employment for 8 families as well.

Oh please, I grew uP on that block. People are making it seem as if that area was once an upscale, quiet, and peacefull area. AnyOne remember the OTB? There are tOns of other thing to be taken care of on that block. Let's get rid of the drug dealers, the crackheads, the underground gamblers, and the hooker tHat have been there for ages. THE CART DID NOT ATTRACT any of these negative people. They were always there. Wanna talk about garbage? Look at the mice playing around in the bagel stores garbage! Plus what the —— is the bagel store complaining about? Bagel stores make most there sales in the morning hours, no one is buying chicken n rice at six am. How is the cart hurting your business. The reason I stopped going to the bagel store is because of the idiot that works there in the morning has an attitude. I'd rather go the extra distance to bagel boy. Plus there bagels are way better. The owner of that spot. My support is for the cart vender. When we get out of lonestart at 4am, these guys at the best option available for food. Not only as a late night option, they are always a good option no matter what time it is. So to who ever installed the benches.. go suckadick!

I support the cart food. It is affordable, tasty one of the best middle easter i had and the staff is friendly. There are many drunk customers on that block because of the bar there and nearby. Many times I have seen cops near the bar, I have never seen cops by the food cart. They are just trying to make a living, they pay all taxes required by the city. If there food tastes better then some of the restaurants in the neighborhood, well tough luck. This is NYC and competition is everywhere, its a matter of supply and demand.

Any illegal acts should not be condoned. Sammy should also listen to the people of the neighborhood and try to fit in. His cart and the one across the street in front of Chase bank are an eyesore. Their flashing signs do not fit in the neighborhood. At night it's very distracting and reminds me of the old discussing 42nd street in Manhattan. They are also dirty. The sidewalk where these carts sit used to be light grey and clean and are now black and dirty from the grease and food they spill. sammy's cart also blocks a traffic sign and a bike lock poll that my tax dollars paid for and no one can access it. That's not very neighborly. I hope CB10 takes away their permits and doesn't allow any food carts in Bay Ridge again.

These people who line up for the food and eat there are coming from the bars in the neighborhood. It's not like they are attracting much of thier customers from far regions of brooklyn. The "filth" can be easily fixed. These guys have been here for 3 years now, a fixture in the neighborhood now. If any logic plays a role here, if these guys were to be removed because of the guy from the "bagel store" I promise you no1 will ever go to his store. His store sucks anyway, its expensive and he is not friendly. He wants to talk about garbage look outside his shop after he closes, the mice and rats are attracted by his garbage.

Let these guys stay, they're are great people and provide an amazing product for the working class.

It's really funny that all those people complaining about this Cart tend to forget that they are there LEGALLY!!!!!! Just like any business that's there they belong there. I don't like alcohol, does that mean Lone Star must shut down, because of all the loudness they produce from their facility. Absolutely Not!!! Does Gentile actually thinks he can speak for a major corporation like Burger King and McDonald's. Calm down Gentile. Now you say that the Cart is Hurting yours and other so called businesses that you represent. So your problem is their inexpensive food and their so called filth and the traffic that they are causing. OK, one step at time

1. I doubt that their filth is really that big of a deal that you're portraying it to be. I've been there many times and their filthiness has not crossed my eyes as a witness.
2. I doubt them being there has caused a ruckus in traffic, though we all know in that area is always populated. It should be populated because its full of all these great businesses that make 86st 86st. I doubt that the cart has really caused any more traffic that their is already. If Gentile's concern was really the corner i think like a good neighbor I would tell Kassen to organize his patron line to best clear the corner from more traffic. You didn't do that of course instead you did another course of action.
3. You think their inexpensive, what about Burger King and McDonald's that you strongly represent. Their meals are $6 tops, not including what you can get from the dollar menu. Yet you use them as example businesses that are struggling in the neighborhood. My advice Gentile is that you should only represent yourself and your own establishment, and leave corporate America alone to defend themselves. You are in no position and in no way shape or form qualified to speak for these businesses. Just stick to your level.

In conclusion I would like to say that people eat what they want to eat, and someone like Gentile should not, and can not tell people where they should eat. It's definitely racial not business, and I think Gentile should be hit with a Hate Crime as soon as possible, because he is very vocal about this issue. Also we should point out that there some of our bravest and finest shown on video supporting Gentile by not doing the right thing. My advise please do your jobs right, and don't let someone like Gentile give you and the guys you work for a bad reputation. Your job is to enforce and uphold the law, not make the law suitable for Gentile because you know him. I love the NYPD and respect them, I would hate that a few bad apples would change my views and and love for them.

What bullies! The Cart owner has every right to be there. Besides, he is not responsible for the "unsavory characters" that eat from his cart.. So you're telling me that the food cart brings in more riffraff than BARS? People have lost their minds. Especially gENTILE
