Bruce Ratner’s Atlantic Yards appears headed for approval later this fall, but opponents say they’ll just take their fight to the courtroom. Here are two legal strategies:
•Develop Don’t Destroy Brooklyn plans to sue on the grounds that the Empire State Development Corporation is illegally condemning private property to advance a favored developer’s project. Ironically, DDDB spokesman Daniel Goldstein’s condo is in one of the buildings to be condemned.
“People are losing their homes and their rights and the Empire State Development Corporation has not put forth an adequate relocation plan,” said Jennifer Levin, an attorney for 10 rent-stabilized tenants who would be displaced by the project.
•The group is also considering a suit if the project’s impacts are not fully disclosed in the final environmental impact statement.
