East Midwood man charged with throwing 4-year-old brother off roof

A man has been charged with second degree murder for allegedly throwing his 4-year-old brother off the roof of an East Midwood apartment block on Sept. 29.

Shimron Smith was killed on Sept. 28 when his 20-year-old brother allegedly threw him off the top of the six-story building on Nostrand Avenue between avenues J and K in the early hours of Friday morning, cops said.

Police responded to a 911 call at 3:31 am and found the child unconscious and unresponsive in the courtyard of the building and emergency medical services pronounced him dead at the scene.

The older brother was taken into custody about 12 hours later that day and charged with the murder of the young boy, according to police.

The cause of death was multiple blunt force injuries, according to a spokeswoman for the Office of Chief Medical Examiner.

The defendant has a history of mental health issues, according to a police spokeswoman.
